Doe Grants and Cooperative Agreements

For commercial enterprises that have never had a grant or cooperation agreement (“CA”), knowing the rules of the game can be a daunting challenge. In this article, we explain what these tools are and provide an overview of the applicable regulations, with a focus on The Department of Energy (“DoE”) regulations. For the purposes of this Article, when we refer to a grant, we are also referring to a cooperation agreement, unless otherwise stated. For example, the Department of Energy issued its regulations at 2 CFR 910. Specifically, 2 CFR 910.102 states: **Reminder: Form DOE 4620 can only be used by DOE national laboratories. All other applicants for grants and cooperation agreements are not permitted to use DOE Form 4620. This is just an overview of the requirements that a recipient must meet as part of a DoE grant. With a grant and a CA, the primary purpose of the transaction is to transfer something of value to a recipient to achieve a public objective of support or stimulation authorized by law, rather than to acquire goods or services for the benefit or direct use of the government.
